These Terms of Service (the “Terms”) govern your use of the Pocketplur application (the “App”) provided by SJD Labs, LLC (“Pocketplur,” “we,” or “us”). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.
Eligibility
You must be at least 13 years old to use the App. If you are between 13 and 18, you represent that a parent or legal guardian has reviewed these Terms with you and consents to your use of the App.
Your account
You are responsible for the activity on your account and for keeping your sign-in credentials secure. Notify us at developer@sjdlabs.com if you suspect unauthorized access. You can delete your account at any time from inside the App.
Acceptable use
You agree not to:
- Violate any law or any third party’s rights;
- Post content that is defamatory, harassing, threatening, hateful, sexually explicit, or infringes intellectual-property rights;
- Interfere with or disrupt the App or its servers;
- Attempt to circumvent rate limits, authentication, or any other technical protections;
- Use the App to send unsolicited messages or to scrape or redistribute App content; or
- Impersonate any person or misrepresent your affiliation with any person or entity.
User content
You retain ownership of the content you create in the App (festival picks, group posts, meetups, polls, and similar). You grant us a non-exclusive, worldwide, royalty-free license to host, display, store, transmit, and share that content within the App as needed to operate the features — for example, sharing your picks with the groups you join. This license ends when you delete the content or your account, except as needed to comply with legal obligations.
Festival data
Lineup data, set times, stages, venue layouts, and similar festival-provided information are surfaced as a convenience and may be incomplete or inaccurate. The App is not affiliated with or endorsed by any festival. Always verify schedules and venue information with the festival’s official sources.
Third-party services
The App may display content from third-party services, including Spotify embedded players on artist detail screens. Your interaction with those embeds is governed by the relevant third party’s terms and privacy policy.
Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT FESTIVAL DATA WILL BE ACCURATE.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SJD LABS, LLC AND ITS OFFICERS, MEMBERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE APP WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
Termination
We may suspend or terminate your access to the App at any time, for any reason, including violation of these Terms. You may stop using the App and delete your account at any time from the Settings screen.
Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the App will be brought exclusively in the state or federal courts located in California, and you and we consent to the jurisdiction of those courts.
Changes to these Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date. Continued use of the App after a change constitutes acceptance of the revised Terms.
